Grand Hyatt Singapore’s “Moments of More” Contest
Official Rules

BY PARTICIPATING, YOU GRANT SPONSOR A LICENSE TO USE YOUR CONTENT AS MORE FULLY DESCRIBED BELOW. Participation in the Contest is only allowed in English. Use of World of Hyatt points Grand Prize is subject to terms and restrictions and requires winner to create an account, provide personal information, and agree to program terms available at https://help.hyatt.com/en/hyatt-terms/world-of-hyatt-terms.html. Do not participate in the Contest if you do not agree.

1. OVERVIEW

  • Grand Hyatt Singapore’s “Moments of More Contest” (the “Contest”) is operated and sponsored by Grand Hyatt Singapore (“GHS” or “Sponsor” or the “Company”),10 Scotts Rd, Singapore 228211. The Contest entry period begins at 09:00:00am Singapore Time (“SGT”) on August 28, 2023, and ends at 23:59:00 SGT on September 29, 2023 (the “Contest Period”). You may enter the Contest by following all instructions as more fully described in the “How to Enter” section below and complying with all of the details in these Official Rules. Following the conclusion of the Contest Period, finalists will be determined based upon the criteria set forth by Sponsor, described in more detail below. As a condition of participating, all finalists agree to sign documentation confirming their agreement to all aspects of these rules to proceed in the Contest. Confirmed finalist entries will then be posted at the Contest Website (defined below) for public voting, which will be used in combination with the judging criteria to determine which Finalists will get the Grand and Runner-Up prizing. By taking any step to participate in this Contest, you fully and unconditionally agree to and accept these Official Rules and the decisions of Sponsor (each, an “Entrant” or “you”).

2. ELIGIBILITY

  • This Contest is open only to individuals who as of the first date of participation and throughout the Contest Period through the time of prize award: (a) are at least eighteen (18) years of age or older and the age of majority in their jurisdiction of residence, and (b) are NOT domiciled in and are NOT residents or citizens of Quebec, Canada, Crimea, Cuba, North Korea, Iran, or Syria, or any country or jurisdiction that is the target of U.S., Singapore, or United Nations trade or economic sanctions (as such list may be amended) or where the laws of the United States, Singapore, or local law prohibits their participation or receiving a prize in this Contest (the "Territory"). You agree not to participate in the Contest in any jurisdiction where all or any portion of this Contest may violate any legal requirements. You are responsible for compliance with all laws applicable to participating. If participating in the Contest would result in you violating any law, rule, regulation, order, or employer policy applicable to you or any agreement to which you are a party, then you are ineligible to participate. As a condition of participating in the Contest, you agree that, if requested by Sponsor, you will provide documentation or other proof of your eligibility within the requested timeframe.

  • Sponsor has the absolute discretion at any time and from time to time to determine the eligibility of anyone to take part in the Contest and will not be obliged to give any reason or basis for its decision.

  • Part-time or full-time staff, employees, officers, directors, members, managers, agents, and representatives of Sponsor and their respective corporate partners, parent companies, divisions, subsidiaries, affiliates, assigns, and successors in interest, each of their respective auditors, advertising agencies, promotion and public-relation agencies and any other persons involved (directly or indirectly) in designing, organizing, promoting, or fulfilling of the Contest, (collectively, the “Released Parties”) and the immediate families (defined for these purposes as any spouse, partner, parent, legal guardian, child, legal ward, sibling, grandparent, or grandchild and each of their respective spouses) and individuals living in the same household as such persons (whether or not related) are not eligible to participate or win the prize in this Contest.

  • This Contest is void outside of the Territory and where prohibited by law

3. HOW TO ENTER

  • To enter, eligible individuals must follow the on-screen instructions, including to submit their contact information and upload at least one (1), but no more than six (6), original photo(s) or video(s) at the dedicated contest website located at momentsofmore.sg (“Contest Website”) within the Contest Period (each, an “Entry” or collectively, “Entries”). Each Entry must contain a caption with the hashtags #MomentsofMore and #HyattContest and tag @grandhyattsing (“Required Tags”). Entrant’s photo(s) and/or video(s) and caption (collectively, “Content” or "Entry Content”) must comply with these Official Rules and the “Content Requirements” detailed below. Please note: Content uploaded without the Required Tags will be deemed ineligible and subject to disqualification. Upload to or “following” Sponsor on social platforms is optional and not required for participation.

  • A limit of one (1) Entry may be submitted by an Entrant under one (1) email address. Any person who is found to have submitted more than one (1) Entry will be disqualified and all such Entries submitted by such person during the Contest Period may be disqualified, and the prize won may be forfeited in the Sponsor’s sole discretion. If multiple Entrants are found to have submitted any of the same Entry Content, all related Entries will be disqualified.

  • Each Entrant will be eligible to win only ONE (1) Prize.

  • Sponsor’s clock will be the official timekeeper for this Contest. Entries must be submitted and received by Sponsor during the Contest Period in strict accordance with the instructions and restrictions in these Official Rules. Entries that are not timely received by Sponsor will not be entered into the Contest. For purposes of this Contest, an Entry is “received” when all required elements are logged through the Contest Website. Other proof of submitting or attempting to submit a purported Entry (such as, without limitation, a “Thanks for Entering: Moments of More” message following submission of an Entry) does not constitute proof of actual receipt of the purported Entry for purposes of this Contest.

  • Entries that contain any material which GHS, in its sole and absolute discretion, deems inappropriate, indecent, obscene, objectionable, hateful, tortuous, defamatory, slanderous or libelous, or contain material that GHS, in its sole and absolute discretion, deems to promote bigotry, racism, hatred or harm against any group or individual or to promote discrimination (whether based on race, gender, religion, nationality, disability, sexual orientation or age) will not be accepted and are void. Entries that contain any material that breaches any applicable laws or regulations including, without limitation, the laws or regulations in the jurisdiction in which an Entry is submitted will not be accepted and are void. Entries that are fraudulent, forged, altered, incomplete, lost, late, misdirected, mutilated, illegitimate, incomprehensible, garbled, or generated by a macro, bot, or through other automated means will not be accepted and will be void.

  • As a condition of entering the Contest, without limiting any other provision in these Official Rules, each Entrant gives consent for Sponsor and its agents to obtain and deliver their name, address, and other information and content to third parties for the purpose of administering this Contest and complying with applicable laws, regulations, and rules

  • For the avoidance of doubt, GHS will not be responsible or liable: (a) for ensuring that Entries are posted to third party social platforms at the election of Entrant; (b) for any Entry that fails to reach GHS for any reason whatsoever or for any failure, technical error or delay in the transmission of the Entry to GHS for any reason whatsoever before the expiry of the Contest Period; (c) for any failed, incomplete, distorted, undelivered, late, damaged, illegible or lost Entries; or (d) for any breakdown or malfunction in any computer system or equipment or network connection or internet connection, which may result in the Entrant being omitted from taking part in the Contest or for any claim or cause of action arising out of or in connection with the Contest. No appeal, correspondence, or claims for payment of compensation will be considered or granted.

4. CONTENT REQUIREMENTS

  • All Content must meet all of the following requirements, as determined by Sponsor in its sole discretion, or the associated Entry may be disqualified:

    • Entry Content must be created entirely by the submitting Entrant and must NOT have been created using any AI or other machine learning tools.
    • Entry Content must contain at least one (1) photo or video and a maximum of six (6) photos or videos. Entry Content may contain a mixture of photos and videos.
    • Entry Content must depict, describe, or otherwise reference a minimum of one (1) place and a maximum of three (3) places, which must be locations in Singapore recommended by the Entrant (“Recommended Places”), but note that promoting a business is prohibited in the Entry Content. Any obvious business names, trademarks, logos, or other intellectual property must not be included in the Entry Content.
    • The Entry Content and Recommended Places must relate to any one (1) or more of the Contest themes, which are the following: (a) Local recreation activities; (b) Ways to recharge in the city in nature; (c) Sustainability activities (collectively, the “Themes”).
    • Written Entry Content must be in English and must be limited to the number of characters allowed on the Contest Website.
    • Entry Content must not depict any other identifiable person or contain an Entrant’s private/personal information or that of any third party (for example, name, address, phone number, email address or any other contact details). GHS will not be responsible for any loss or damages suffered as a result of or in connection with such posting.
    • Entry Content must not infringe, misappropriate, or violate any rights of any third party including, without limitation, copyright (including moral rights), trademark, trade secret, or rights of privacy or publicity.
    • Entry Content must not include information or content that is false, fraudulent, deceptive, misleading, defamatory (including trade libel), disparaging, harassing, threatening, profane, obscene, pornographic, hateful, indecent, negative, inappropriate, or injurious to any Released Party or any other party.
    • Entry Content must not contain or describe any harmful or illegal activity or content or in any way violate any federal, state/provincial/territorial, or local laws, rules, or regulations.
    • Entry Content must be suitable for presentation in a public forum.
    • Entry Content must not suggest, depict, or describe any inappropriate, unlawful, or dangerous behavior or use of Sponsor’s or any other products or services.
    • Photos must not exceed 5MB and videos must not be more than 30-seconds or exceed 150MB.
    • You agree that your participation in the Contest and agreement to these Official Rules and any Released Party’s display and use of the Entry Content will not violate any agreement to which you are a signatory or party and that no such agreement otherwise limits your ability to participate in this Contest or the rights granted to Sponsor in these Official Rules..
    • By participating, you agree to indemnify the Released Parties against any and all claims from any third party for any use by any Released Party of the Entry Content authorized pursuant to these Official Rules..

  • Sponsor reserves the right in its sole discretion to disqualify you from the Contest if your Entry Content – as determined by Sponsor in its sole discretion – refers, depicts, or in any way reflects negatively upon a Released Party, the Contest, or any other person or entity or does not comply with these Content Requirements or any other requirement of these Official Rules.

5. FINALIST AND WINNER SELECTION

  • Following the end of the Contest Period, the Entry Content from all eligible Entries received will be evaluated by a panel of judges selected by Sponsor (the “Judges”) in two (2) rounds of judging. The first round of judging, which will determine the five (5) Finalists (defined below), will be based on the following criteria according to the percentage weights indicated (“First Round Criteria”):

    • ORIGINALITY (50%): Share in the caption what these recommendations mean to you and why they are unique

    • CREATIVITY & AESTHETICS (40%): Let your creativity juices flow and share tips based on one or more Themes:
    • (a) Local recreation experiences;
    • ((b) Ways to recharge in the city in nature;
    • (c) Sustainability activities.

    • PUBLIC APPEAL (10%): In the first round of judging, the Judges will assign a score to each Entry Content to indicate how likely it is to have public appeal based on the Judges’ own perspective.

  • The five (5) Entries receiving the highest total scores will be deemed finalists, subject to verification, (“Finalists”) and will be required to read, agree to, and sign documentation confirming their agreement to these Rules (including a liability release and grant of rights) as a condition of proceeding in the Contest, otherwise they will be disqualified. If any potential Finalist is disqualified, Sponsor will determine and notify the Entrant with the next highest score, time permitting.

  • Verified Finalist Entry Content will be posted to a select page on the Contest Website (“Voting Website”) for public voting, which will begin on October 16, 2023 and ends on October 25, 2023 (the “Voting Period”).

  • The second round of judging will determine the winner of the Grand Prize (defined below), which will be based on the Entrant Content that receives the highest score using following criteria according to the percentage weights indicated (“Second Round Criteria”):

    • ORIGINALITY (50%): Share in the caption what these recommendations mean to you and why they are unique

    • CREATIVITY & AESTHETICS (40%): Let your creativity juices flow and share tips based on one or more Themes:
    • (a) Local recreation experiences;
    • (b) Ways to recharge in the city in nature;
    • (c) Sustainability activities.

    • PUBLIC APPEAL (10%): The results of the Voting will be used as 10% of the score in this round.

  • In the event of a tie, the Entry with the highest score for the “CREATIVITY & AESTHETICS” criteria in a given round will determine the Finalist/Grand Prize winner, as applicable for the relevant round of judging.

  • Sponsor reserves the right to contact Entrants for verification purposes and administration of the Contest. All Judges’ decisions are final and binding in all matters relating to this Contest. Each Entrant acknowledges that other Entrants may have created ideas and concepts contained in their Entry Content that may have familiarities or similarities to their Entry Content and agrees that they will not be entitled to any compensation or right to negotiate with the Released Parties because of these familiarities or similarities.

6. PUBLIC VOTING & WINNER NOTIFICATION

  • During the Voting Period, individuals can visit the Voting Website and follow the instructions to provide their email address and vote for their two (2) favorite Finalist Entry Content based upon the Second Round Criteria. Each individual may vote once during the Voting Period for their two (2) favorite Finalist’s Entry Content. Subsequent votes submitted by any person in excess of the stated maximum limitation will be void. Finalists are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by the Sponsor in its sole discretion. Use of these techniques, creation or use of multiple email addresses to exceed the vote limits, or of any script, macro, or other automated or artificial system to vote, or with the intent or effect of impairing the integrity of the voting process, is prohibited and all such votes will, upon discovery by the Sponsor, be deemed null and void and may lead to the disqualification of the applicable entrant. All Finalists are prohibited from conducting their own publicity campaign or promotions in connection with this Contest.

  • There will be a total of five (5) winners (each a “Winner” and collectively the “Winners”). There will be one (1) Winner of the Grand Prize (defined below) (“Grand Prize Winner”). The remaining four (4) Finalists who do not win the Grand Prize will receive a Runner-Up Prize (defined below) (“Runner-Up Prize Winners”).

  • The Winners will be contacted within approximately three (3) business days of the end of the Voting Period. All Winners will be contacted via the email address they provided, and they are required to respond according to Sponsor’s instructions in the notification within seven (7) days including providing a signed prize release in the form provided by Sponsor. Failure to do so will result in the forfeiture of the respective Prize.

  • GHS’s decision of, and method of selecting, the Winner will be at its absolute discretion and will be final, conclusive, and binding. GHS will not be liable for payment or compensation to any party resulting from GHS’s choice of the Winners or to any Entrant not being eligible to receive the Prize offered under the Contest. No appeal, correspondence or claims or payment of compensation will be accepted.

  • GHS will provide Winners, via the email address the Winner provided with verification documents including a prize release. The Winner must complete and return all documentation within seven (7) days of receipt, as well as send GHS a copy of their identity card, FIN, or passport. GHS may request that the Grand Prize Winner provide additional information in order to verify the Grand Prize Winner’s account.

  • Sponsor may retain information provided as part of Contest participation to the maximum extent allowed by applicable law.

  • GHS reserves the right to select alternate Winners to substitute any Winner who is subsequently found to be ineligible or disqualified or where the Winner is unable to furnish satisfactory proof that they are indeed the same person as the individual who submitted the winning Entry (for example, by showing all documentary evidence of proof of name and identification number etc.) The Finalist with the second-highest score will be selected as the alternate Grand Prize Winner, should the Grand Prize Winner be ineligible or disqualified. In this event, only one (1) alternate Grand Prize Winner will be selected.

  • Sponsor may announce the Finalists or Winners and display their Entry Content publicly, including, without limitation, on the Contest Website, Sponsor’s social media accounts and feeds, and elsewhere.

7. PRIZES & APPROXIMATE RETAIL VALUE

  • There are two (2) types of prizes associated with this Contest: Grand Prize and Runner-Up Prize, each defined below (collectively, the “Prizes”). The Prizes are each subject to their own set of terms and conditions. Redemption of the Prizes is subject to a fixed redemption period and availability. Prizes are provided "as is" without further representation, warranty or guarantee of any kind, express or implied. In the event any element of any prize becomes unavailable before it is both awarded and redeemed for any reason beyond the reasonable control of GHS, GHS will provide a substitute prize selected in its sole discretion. However, if after prize award, a Winner becomes unable to use or redeem any portion of their Prize, that Winner forfeits use of the prize and Sponsor will not be responsible for any payment or awarding any substitution.

  • GRAND PRIZE: One (1) Grand Prize Winner will be awarded one (1) prize totaling 1,000,000 (One Million) World of Hyatt points (the “Grand Prize”). The Grand Prize does not have a dollar value. World of Hyatt points awarded can be redeemed at any participating Hyatt Hotels and Resorts. The terms and conditions of World of Hyatt bonus points apply. Any additional expenses related to travel to the hotel, in room dining, restaurants or bar, spa or other onsite amenities and services are not included in the Grand Prize and are Grand Prize Winner’s sole responsibility. The Grand Prize Winner must have a valid World of Hyatt account (“Account”) number to claim and receive the Grand Prize. If the Grand Prize Winner does not already have an Account, he or she can visit https://www.hyatt.com/en-US/member/enroll and follow the links and instructions to create an Account at no cost.

  • RUNNER-UP PRIZES: The four (4) Finalists who are not the Grand Prize Winner are each a Runner-Up Winner. Each Runner-Up Winner will be awarded one (1) voucher for a two (2)-night stay in GHS in one (1) standard room for two (2), combined with a SGD 600 hotel credit for in-hotel expenses (“Voucher” or “Runner-Up Prize”). The approximate retail value (“ARV”) of a Runner-Up Prize is SGD2,200. The ARV of all Runner-Up Prizes is SGD2,200. Vouchers are valid until 30 Dec 2024. There is no extension of a Voucher after the expiry date. Voucher must be presented by providing the unique code associated with the Voucher at the time of redemption for it to be applied. Advance booking at https://www.hyatt.com/en-US/hotel/singapore/grand-hyatt-singapore/sinrs/rooms is required and subject to availability at point of booking. A Voucher is not an eligible payment method allowing World of Hyatt members to earn Base Points for Tier-Qualifying Night credits for hotel accommodation. A Voucher is not valid from 18 February 2024 to 22 February 2024, 20 September 2024 to 22 September 2024, and 30 December 2024 to 31 December 2024 (“Blackout Dates”). GHS reserves the right of final decision in case of any dispute arising from use of a Voucher and the right to request alternative forms of payment if a Voucher is fraudulently obtained or used. A Voucher is not returnable, refundable, or redeemable for cash, and may not be resold or transferred for value. A Voucher expires as set forth above. There will be no refund or credit for unused portions. A Voucher transferred fraudulently, unlawfully, or otherwise in violation of these terms, is subject to cancellation. GHS reserves the right to institute additional security and verification procedures at the time of Voucher redemption for fraud prevention.

  • The following applies to all Prizes and Winners:

  • No prize substitution or exchange will be allowed. The Winner will be solely responsible for payment of any and all applicable federal, state, provincial, territorial, and local taxes. If a potential Winner is disqualified, found to be ineligible, declines to accept a prize or, if GHS is unable to contact the Winner, or a Contest-related communication or a prize or communication is returned undeliverable, the Prize may be forfeited and awarded to an alternate winner. A Winner may be required to furnish proof of identification at Sponsor’s sole discretion. Sponsor is not responsible for Winner’s privacy or spam filter settings, which may divert any Contest-related message or e-mail, including any notification, to a spam or junk folder.

  • GHS may, at any time and from time to time in its sole and absolute discretion and without prior notice or assigning any reason thereof or assuming any liability or payment of compensation to any person, substitute, replace or change the Prizes stipulated in these Rules, with another prize of similar value (whether in cash or otherwise). GHS’s determination of the substituted prize will be final, conclusive and binding. No appeal, correspondence or claims will be accepted.

  • Winners agree not to use prizes in any way, directly or indirectly, that would violate applicable laws, including, without limitation, in any manner that would constitute bribery, an illegal kickback, an illegal campaign contribution, or any other violation of applicable anti-corruption, political activity, economic sanctions, or other laws.

8. LICENSE RIGHTS GRANTED BY ENTRANTS

  • By participating in the Contest, to the maximum extent permitted by applicable law, every Entrant and each Winner expressly and irrevocably acknowledges and agrees that submitting Entries constitutes such Entrants’ and Winners’ consent to give the Released Parties (and their agents, successors, and assigns) a worldwide royalty-free, irrevocable, transferrable, assignable, perpetual, non-exclusive license to use, reproduce, publish, create derivative works from and display such Entries and Entry Content, in whole or in part, and to incorporate it into other works, in any form, including for promotional or marketing purposes. The Entrant will, if requested by GHS, sign documentation that may be required for GHS or its nominees to make use of and to assign to GHS or its nominees the non-exclusive rights that the participants are granting to use the Entries and Entry Content, whether in whole or in part, without any payment or compensation thereof and in such mode and manner as will be decided by GHS at its absolute discretion.

  • By participating in the Contest, to the maximum extent permitted by applicable law, every Entrant and each Winner expressly and irrevocably grants the Released Parties the irrevocable, sublicensable, absolute right and permission to use, publish, post or display their name, photograph, likeness, voice, prize information, biographical information, any quotes attributable to them and any other indicia of persona (regardless of whether altered, changed, modified, edited, used alone, or used with other material in the Released Parties’ sole discretion) for advertising, trade, promotional and publicity purposes without further obligation or compensation of any kind to them, anywhere, in any medium now known or hereafter discovered or devised (including, without limitation, on the Internet), worldwide, without any limitation of time, and without notice, review, or approval and each Entrant releases all Released Parties from any and all liability related thereto. Nothing contained in these Official Rules obligates Sponsor to make use of any of the rights granted in these Rules and Entrant waives any right to inspect or approve any such use.

  • By entering the Contest, each Entrant agrees to co-operate and participate in any advertising, promotional and publicity and/or commercial activities organized by GHS in relation to the Contest and consents and authorizes GHS to use and disclose any data provided by the Entrants for any future marketing effort by GHS.

9. LIMITATION OF LIABILITY

  • EACH ENTRANT AGREES TO RELEASE, DISCHARGE, HOLD HARMLESS, AND INDEMNIFY EACH OF THE RELEASED PARTIES FROM AND AGAINST ANY CLAIMS, DAMAGES, DISABILITIES, ATTORNEYS' FEES, AND COSTS OF LITIGATION AND SETTLEMENT, AS WELL AS ANY LIABILITY WHATSOEVER, FOR INJURIES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH: (i) THE CONTEST; (ii) THE USE, ACCEPTANCE, POSSESSION, MISUSE OR AWARDING OF THE PRIZE; OR (iii) WHILE PREPARING FOR, PARTICIPATING IN, AND/OR TRAVELING TO OR FROM ANY CONTEST-RELATED ACTIVITY, INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, OR ACCIDENT TO/OF PERSON OR PROPERTY.

10. DISPUTES / GOVERNING LAW

  • Except where prohibited by law, any and all disputes, claims, and causes of action between an Entrant and any Released Party arising out of or connected with this Contest or these Official Rules must be resolved individually, without resort to any form of class action or legal action on behalf of any group. Further, in any such dispute, under no circumstances will an Entrant be permitted or entitled to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than the Entrant’s actual out-of-pocket expenses (if any), not to exceed ten dollars ($10) and each Entrant further waives all rights to have damages multiplied or increased.

  • The Contest (whether for breach of contract, tortious conduct, or otherwise) will be governed by the laws of Singapore, without giving effect to its conflicts of law or choice of law principles or rules that would cause the application of the laws of any other jurisdiction. Any legal actions, suits or proceedings related to this Contest (whether for breach of contract, tortious conduct, or otherwise) will be brought exclusively in the Singapore Courts, and each Entrant will be deemed to have irrevocably agreed to submit to the exclusive jurisdiction of the Singapore Courts with respect to any legal actions, suits or proceedings arising out of or related to this Contest.

  • These Official Rules will be in English only, which language will prevail, govern, and control in all aspects, and all translated versions of these Official Rules in any other language will be for reference only and will not be binding. In the event of any discrepancy or inconsistency between the English version and any translated version, the English version will prevail.

11. ADDITIONAL DISCLAIMERS

  • The Released Parties are not responsible and/or liable for any of the following, whether caused by a Released Party, the entrant, or by human error: entries that are submitted by illegitimate means (such as, without limitation, by an automated computer program) or entries in excess of any stated limit; any lost, late, incomplete, illegible, unintelligible, garbled, mutilated, or misdirected entry, email, mail, or Contest-related correspondence or materials or postage-due mail; any error, omission, interruption, defect or delay in transmission, votes or communication; viruses or technical or mechanical malfunctions; interrupted or unavailable cable or satellite systems; errors, typos, or misprints in these Official Rules, any Contest-related advertisements, or other materials; failures of electronic equipment, computer hardware, or software; lost or unavailable network connections or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications or entry information. Released Parties are not responsible for electronic communications that are undeliverable or do not reach entrant as a result of any form of active or passive filtering of any kind or insufficient space in a potential winner’s email or voicemail inbox. Released Parties are not responsible, and may disqualify an entrant, if the entrant’s email address or other contact information does not work or is changed without prior written notice to Sponsor. Without limiting any other provision in these Official Rules, the Released Parties are not responsible or liable to any entrant or winner (or any person claiming through such entrant or winner) for failure to supply the prize or any part thereof in the event that any of the Contest activities or Released Parties’ operations or activities are affected by any cause or event beyond the sole and reasonable control of the applicable Released Party (as determined by Sponsor in its sole discretion), including, without limitation, by reason of any acts of God, equipment failure, threatened or actual terrorist acts, air raid, act of public enemy, war (declared or undeclared), civil disturbance, insurrection, riot, epidemic, fire, explosion, earthquake, flood, hurricane, unusually severe weather, blackout, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, any law, rule, regulation, action, order, or request adopted, taken, or made by any governmental or quasi-governmental entity (whether or not such governmental act proves to be invalid), or any other cause, whether or not specifically mentioned above.

12. GENERAL RULES

  • Sponsor’s decisions will be final in all matters relating to this Contest, including interpretation of these Official Rules, selection of the winner, and awarding of the prize. All participants, as a condition of entry, agree to be bound by these Official Rules and the decisions of Sponsor. Participants further agree to not damage or cause interruption of the Contest and/or prevent others from participating in or engaging with the Contest. Sponsor reserves the right to restrict or void entries or other participation from any IP address if any suspicious entry and/or participation is detected. Sponsor reserves the right, in its sole discretion, to void the entry of any entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Contest. Sponsor’s failure or decision not to enforce any provision in these Official Rules will not constitute a waiver of that or any other provision. In the event there is an alleged or actual ambiguity, discrepancy, or inconsistency between disclosures or other statements contained in any Contest-related materials and/or these Official Rules (including any alleged ambiguity, discrepancy, or inconsistency within these Official Rules), it will be resolved by Sponsor in its sole discretion. Entrants waive any right to claim ambiguity in the Contest or these Official Rules. If Sponsor determines at any time in its sole discretion that a winner or potential winner is disqualified, ineligible, in violation of these Official Rules, or engaging in behavior that Sponsor deems obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, or harass any other person, Sponsor reserves the right to disqualify that winner or potential winner, even if the disqualified winner or potential winner may have been notified or displayed or announced anywhere. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules will otherwise remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained in these Rules. If the Contest is not capable of running as planned for any reason, Sponsor reserves the right, in its sole discretion, to cancel, modify, or suspend the Contest and award the prize from eligible entries received prior to cancellation, modification, or suspension or as otherwise deemed fair and appropriate by Sponsor. If any person supplies false information, obtains entries by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain a prize, Sponsor may disqualify that person and seek damages from them and that person may be prosecuted to the full extent of the law. In the event of a dispute concerning the identity of an entrant, the entrant will be declared to be the registered account holder of the email address provided in the Entry Form submitted through the Website, but only if that person meets all other eligibility criteria, otherwise the entry may, in Sponsor’s sole discretion, be disqualified and any potential prize won will be forfeited. A registered account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the applicable email address. The potential winner may be required to provide Sponsor with proof that he or she is the registered account holder of the email address from which the potentially winning entry was submitted. If a dispute cannot be resolved to Sponsor’s satisfaction, the entry will be deemed ineligible. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE CONTEST VIOLATES CRIMINAL AND CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANT MAKING SUCH ATTEMPT AND MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

  • While all information provided in these Rules is believed to be correct and reliable at the time of publishing or posting online, GHS makes no representation or warranty whether express or implied, and accepts no responsibility or reliability for its completeness or accuracy. In the event of any inconsistency between these Official Rules and any advertising, promotional, publicity and other materials relating to or in connection with the contest, these Official Rules will prevail.

  • These Official Rules will be in English only, which language will prevail, govern and control in all aspects, and all translated versions of these Official rules in any other language will be for reference only and will not be binding. In the event of any discrepancy or inconsistency between the English version and any translated version, the English version will prevail.

  • In the event of any discrepancy or inconsistency between the Official rules and disclosures or other statements contained in any Contest-related materials, the Official Rules will prevail, govern, and control.

By entering the Contest, Entrants agree to the Company’s collection and usage of personal data and acknowledge that they have read and accepted the Company’s privacy policy and the personal information collection statement.

14. WINNER’S LIST / OFFICIAL RULES

  • A copy of these Official Rules is available during the Contest Period at the Contest Website or upon request by emailing [email protected] with the subject line “Request for Contest Rules”. Rules requests must be received before the end of the Voting Period. For information about who won, send an email to [email protected] with the subject line “Request for Contest Results”. Requests for winner information must be received no later than three (3) months after the end of the Voting Period.
